These Terms of Use (“Terms”) apply equally to the iOS App Store and Mac App Store editions of BitFile. This English version is an applicable document with the same provisions and effect as the Japanese version. The version published on this webpage is the controlling English version, and the application displays provisions with the same meaning. Features, permissions, and screen content may differ by platform. The developer and provider of BitFile is Miyamoto Kazuhiro, trading as Ada Foundry (the “operator”). The seller name displayed on the App Store is determined by Apple.

1. About BitFile

BitFile is an application that encrypts and manages files on the user’s device, with its basic processing completed locally. During ordinary use, vault files, file names, folder structures, tags, passwords, recovery information, and encryption keys are not automatically sent to the operator’s server.

BitFile is not a cloud storage service. Features that communicate externally and the handling of data in those features are described in the Privacy Policy.

2. Acceptance of these Terms

For both the iOS App Store edition and the Mac App Store edition, the user may use BitFile after accepting these Terms and reviewing the Privacy Policy. The Privacy Policy explains the information handled by the operator and the choices available to the user. If handling that legally requires separate consent is added, consent will be requested before that handling begins. Minors must obtain the consent of a parent, guardian, or other legal representative when required.

Where Apple’s standard Licensed Application End User License Agreement (“Standard EULA”) applies, these Terms supplement that agreement with conditions concerning BitFile’s encrypted vault, Plus, data handling, and security features. These Terms are not a Custom EULA that replaces Apple’s Standard EULA. If the two conflict, applicable mandatory law and Apple’s Standard EULA govern.

The revision to these Terms version 2.4.0 and Privacy Policy version 2.4.0 clarifies existing handling and strengthens user protections. Acceptance and review already recorded for the immediately preceding valid pair—Terms version 2.3.0 and Privacy Policy version 2.4.0—are not invalidated solely because of this revision. Any new acceptance and review record uses the current version pair.

3. Passwords, recovery information, and backups

  1. The operator does not obtain the user’s password, recovery information, or encryption keys and cannot decrypt the vault on the user’s behalf.
  2. The vault may be unrecoverable if both the password and all recovery information are lost.
  3. After the last successful unlock, each failed unlock attempt is retained for 24 hours of time while BitFile is running and does not expire during time when the app is terminated or the device is off. When 30 retained failures accumulate, the wrapped key and recovery methods used to open BitFile data are immediately and irreversibly destroyed. BitFile then attempts to delete the encrypted data remaining on the device. Even if physical deletion cannot be completed because of the condition of the operating system, storage device, or other circumstances, the remaining BitFile data cannot be decrypted because the destroyed key and recovery methods cannot be restored.
  4. The user must keep the password and recovery information secure and keep a backup of important files in a location separate from BitFile.

4. External services and paid features

  1. BitFile Plus, the paid feature set for the iOS App Store and Mac App Store editions, is offered through Apple StoreKit as a monthly or yearly auto-renewable subscription. One Plus subscription unlocks Plus on iPhone, iPad, and Mac, and purchases can be restored with the same Apple Account. Family Sharing is not supported. Files, vaults, encryption keys, and settings do not sync between devices and remain stored locally on each device. Immediately before the user confirms a purchase, BitFile displays the product name, price, subscription period, whether the subscription renews automatically, the amount charged at each renewal, the cancellation terms, and that service begins after the purchase is completed. The user must also review the actual purchase terms shown on the App Store purchase confirmation screen.
  2. Charges are billed to the user’s Apple Account. An auto-renewable product renews for the displayed period and amount unless the user stops renewal in the App Store account settings. After cancellation, paid features generally remain available until the end of the already-paid period. Subscriptions must be canceled through App Store subscription management, and refunds are subject to Apple’s terms and procedures.
  3. When a Plus access period ends, existing files in BitFile are not automatically deleted, and the user may continue to view, play, export, move, rename, and delete them. If the number of stored files exceeds the Free plan limit of 50 files, BitFile restricts only operations that increase that number, such as adding a new file, duplicating a file, extracting an archive, or restoring a file from the Trash.
  4. When the user explicitly shares or exports data, that data is transferred to the destination or save location selected by the user.

5. Prohibited conduct

The user must not engage in any of the following conduct:

  1. Conduct that violates laws or public order and morals
  2. Conduct that infringes the rights of a third party
  3. Conduct that interferes with the operation of BitFile or an external service
  4. Unauthorized access, improper circumvention of protective features, or conduct intended for unauthorized use
  5. Other conduct prohibited by law

This section does not restrict research, analysis, interoperability work, or other conduct permitted by law or an open-source license.

6. Intellectual property

BitFile and the third-party software included with it are subject to their respective license terms. These Terms do not transfer to the operator any rights in files stored by the user.

7. Suspension and changes

The operator may suspend or change online features or the contents of the application for maintenance, incidents, legal compliance, or other reasonable grounds. A suspension of online features alone does not cause a vault stored on the user’s device to be deleted automatically.

8. Warranties and liability

  1. BitFile is provided as is. The operator does not warrant uninterrupted or error-free operation in every environment, fitness for a particular purpose, or complete security into the future.
  2. The user uses BitFile with the understanding that data may become unavailable because of device failure, operating-system changes, operational mistakes, or loss of passwords or recovery information.
  3. The limitations of liability in these Terms do not apply to loss caused by the operator’s willful misconduct or gross negligence. Whether liability exists, and its scope and amount, are governed by the Consumer Contract Act of Japan and other applicable mandatory law, including where the operator was ordinarily negligent.

9. Changes to these Terms

The operator may change these Terms only to the extent necessary and reasonable in light of the purpose of the change, including changes in law or features and security needs. The changes, the reason for them, and their effective date will be announced before they take effect through the application, the published webpage, or another appropriate method. If a change materially affects user rights, billing terms, or data handling, the application will request explicit acceptance again. Continued use alone will not be treated as acceptance of a material change.

10. Governing law and jurisdiction

These Terms are governed by the laws of Japan. This provision does not restrict any rights or venue available to the user under applicable mandatory law. Disputes concerning these Terms or BitFile will be resolved under applicable law and procedure.

11. Operator and contact

The developer and provider is Miyamoto Kazuhiro, trading as Ada Foundry. Inquiries must be submitted through the Google Form (Google Account sign-in required; external site). A Google Account sign-in is required to open the Google Form. Do not send passwords, recovery information, encryption keys, vault files, or any other secret information.
